Rochester, NY -- Rochester psychiatrist William Lewek will not have his case heard in Drug Court.
Lewek is accused of drug possession and evidence tampering. His lawyer, Matt Parrinello, petitioned to move the case into a special diversion program for people with drug problems. The judge denied his request.
Diversion usually mean reduced charges if the defendant completes the program successfully. The District Attorney's office opposed diversion for Lewek, who is accused of hiding a dead man's body in his back yard.
Although he's not charged with causing Matthew Straton's death, prosecutors said Lewek's crimes should be kept in the criminal courts.
Straton had been missing 11 weeks before his remains were found behind Lewek's Rowley Street home.
